Legal systems adopt different approaches to the Kompetenz-Kompetenz principle. National arbitration legislation varies regarding the versions of the Kompetenz-Kompetenz principle adopted.[1] The principle involves two types of effects. There are two aspects of the “Kompetenz-Kompetenz” principle : the first one is related to the ability of the arbitrators to rule on their own jurisdiction, and the second, and more problematic one, is related to the fact that national courts can rule on the arbitral tribunal’s jurisdiction only after the arbitrators has done so. This second characteristic of the principle, however, is less accepted in national systems, and, as will be illustrated in details later, has given rise to Kompetenz-kompetenz. The ability of the arbitral tribunal to rule on the question of whether it has jurisdiction before intervention by national courts. The principle of kompetenz-kompetenz is well established in international arbitration, and is accepted in many national laws. The principle of kompetenz-kompetenz denotes the ability of arbitral tribunals to decide on their own jurisdiction to proceed with a case. [1] Essentially, this means the tribunal decides whether it can hear a case or not, without the intervention of a court.
